Rent to Own Houses in Nairobi: How It Works

Updated 3 November 2026 · Land & Property editorial team

Rent to own in Nairobi means a contract in which part of your rent counts towards buying the home. The risk sits in the terms: what share of rent is credited, what happens if you default, and whether the seller holds a clean title. As of November 2026, the government's Boma Yangu portal and mortgages refinanced by KMRC are the main regulated alternatives.

What is rent to own, and how is it structured?

Rent to own, also called rent to buy or lease to own, is a contract rather than a product. The buyer moves into a home, pays monthly amounts called rent, and a defined part of those payments is credited to the price. At the end, or when the credits reach an agreed amount, the buyer completes the purchase and receives the title.

The structure can differ from deal to deal. Ask five questions. What is the full price, and is it fixed or can it rise? What share of each payment counts towards the price, and what share is plain rent? Is there an upfront option fee, and is it refundable? Who pays rates, repairs and insurance? Who holds the title until completion? Anything you cannot find in the written contract should be treated as not agreed.

Where is the buyer exposed?

The buyer carries most of the risk because the seller keeps the title during the rent period. Three exposures matter most.

  • Default: many contracts say all credited rent is forfeited if you miss payments. Check whether you get notice and time to remedy.
  • Title: if the seller has a bank charge on the property, or the title is disputed, your payments may be lost. A title search must come before any money moves.
  • Price creep: a clause letting the seller change the price or add fees can make the home unaffordable at the end.

We did not find a dedicated Kenyan rent-to-own statute in our research, so treat the contract as an ordinary sale and lease agreement and have an advocate review it. This is information as of November 2026, not legal or financial advice.

What is Boma Yangu, and is it an alternative?

Boma Yangu is the national digital platform for the government's Affordable Housing Programme. The housing ministry's page describes four steps: register with your National ID and mobile number, save monthly through M-Pesa or bank transfer, choose a project and unit type, then complete the purchase or tenancy agreement. The page lists bedsitter, one-, two- and three-bedroom units. Its headline counters show 200,000 target units and 1,000,000 registered users, but they are formatted unclearly, so check them on the portal. In Nairobi it names Park Road (1,370 units) and the Shauri Moyo redevelopment (2,400 households or units).

The page does not state eligibility rules, deposit amounts or repayment terms, and press reports we saw disagreed on them, so read the notice for the specific project you want and apply only through the official portal. Because this route is run through a public platform, it avoids the private-seller title risk, though you should still read the sale agreement. How do KMRC and bank mortgages compare?

The Kenya Mortgage Refinance Company (KMRC) does not lend to buyers directly. It refinances primary lenders such as banks and Saccos, which then lend to home buyers. The Star reported on 22 November 2023 that KMRC had refinanced close to KES 10 billion of home loans for 12 lenders, had begun offering fixed-rate mortgages of up to 25 years, and offered a single-digit rate of 9.5%, while average market rates had risen from 12% to 18% earlier that year. These figures are nearly three years old, so ask lenders for today's rate.

The difference from rent to own is ownership. With a mortgage you hold the title from completion and the lender takes a charge, whereas under rent to own the seller keeps title until you finish paying. A mortgage needs a deposit and proof of income, and rent to own is often chosen by people who lack either. Run both numbers before committing.

What must a lawyer check?

Before you pay anything, ask your advocate to confirm these points in writing.

  1. An official land search confirms the seller is the registered owner. Our guide Ardhisasa Land Search in Kenya: How It Works explains the process.
  2. No bank charge or caveat is registered against the title, or the lender consents to the arrangement.
  3. The contract states price, credited share, term, fees and who pays for repairs.
  4. Default and refund clauses give notice and a cure period, and say what you get back.
  5. Completion terms say when the transfer is registered in your name and who pays the costs.

What are the red flags?

Walk away if you meet any of these.

  • The seller will not allow a title search before you pay.
  • You are asked for a "deposit only" to hold the house, with the contract to follow.
  • Payments go to a personal mobile number rather than a company or advocate's account.
  • The agent cannot show a registered business or licence.

Public reporting on Nairobi house-hunting scams, such as Kenyans.co.ke's guide, describes fake listings that take deposits. Frequently asked questions

Is rent to own legal in Kenya?

We found no dedicated Kenyan rent-to-own statute in our research. Such deals are treated as contracts, so their enforceability rests on the written terms and general law. Have an advocate review any agreement and search the title before paying.

What happens if I miss a payment?

It depends entirely on the contract. Many agreements let the seller end the deal and keep credited rent. Look for a notice period, a chance to catch up and a refund clause before signing, and keep every payment receipt.

Is rent to own cheaper than a mortgage?

Not necessarily. A mortgage gives you title at completion and may carry a lower rate, as KMRC's 9.5% fixed product reported in 2023 did, while rent to own can cost more over time. Compare the total payments over the full term.

Can I use Boma Yangu to rent a house?

Boma Yangu is the portal for the Affordable Housing Programme, where you register, save and select a project and unit. The ministry page mentions a purchase or tenancy agreement but gives no rent-to-own terms, so check the specific project notice.
