What documents do I need to buy land in Uganda?

The list depends on the stage. Before payment you need proof of who owns the land and who may sell it. At the agreement stage you need a written contract and consents. At transfer you need the forms the Ministry of Lands asks for, and proof that tax is settled. The table groups them by stage and says who supplies each one.

What is a search letter and why do I need one?

A search letter is a statement from the registry on what it holds for the title: the registered owner and the encumbrances. A search on the public portal costs UGX 10,000 according to the Ministry of Lands poster, and the registry also issues search letters. Keep the result and the letter in your file and repeat the search just before payment, because things can change. Read the result with the help of the due diligence checklist.

What must the sale agreement contain?

A written agreement is the paper that records the deal. A sale of land agreement template used by a Ugandan property firm requires the seller to hand over the duplicate certificate of title, fully transferred into the seller's name, and to sign mutation forms where the land is to be subdivided. Your advocate will tailor the clauses. At a minimum record: the names and ID details of both parties, the plot description with title particulars, the size, the price and the payment stages, the date of handover, who pays which taxes and fees, and what happens on default. See the land sale agreement guide and how to pay for land safely.

What are spousal consent and Form 41?

Section 39 of the Land Act restricts the sale of family land without the prior consent of the spouse. For customary land the Ministry of Lands publishes Land Form 41, which records that consent. A mailo transfer also needs two consent forms, according to the Ministry's procedure page. Ask your advocate which form fits your tenure, and have it signed in front of a witness. See how to verify a land seller for the wider family-consent check.

Do I need a TIN to buy land?

Yes, where the land is worth UGX 10 million or more. URA's Tax Education note says the rule took effect on 6 December 2021 and applies to both buyer and seller, and a company needs a TIN even when the value is lower. A TIN is free. Apply on the URA portal or at a Domestic Taxes office with your National ID. URA says the requirement is for registration and visibility and does not itself tax the sale. Where the seller is selling on behalf of a deceased owner, URA treats that person as the seller who needs a TIN.

Which papers are needed for the transfer itself?

The Ministry of Lands procedures page for transferring mailo land lists the transfer form, two consent forms, a photocopy of the duplicate certificate of title, and two passport photographs each of the buyer and the seller. The steps are an assessment at the Ministry, payment of stamp duty and registration fees at the bank, URA stamping of the transfer form, and lodging at the Office of Titles. That page is older and still gives stamp duty as 1%, while URA states 1.5% of the value set by the Chief Government Valuer, so ask for a current assessment. The Ministry's service standards set a target of 3 working days to process a transfer, at UGX 20,000 for the first plot.

Freehold and leasehold transfers follow the same registry route, but check the exact forms with the Ministry or your advocate, because the procedure page we read describes grants, not transfers, for those tenures.

What if the plot is being subdivided?

If you are buying part of a larger title, the seller must subdivide first. That needs a survey and mutation forms, and the Ministry's standard for subdivision or mutation approval is 5 working days at UGX 20,000. Do not pay the final balance until the subdivision is approved and the new title or mutation is ready. See buying land on installments if the seller is subdividing as you pay.

What should a seller hand over, and where do I go next?

Sellers should read documents to sell land. Buyers should compare with buying from the owner or through an agent, buying land or a house and buying at auction. The whole sequence is in how to buy land in Uganda. Browse plots for sale, book an escorted site visit, or go to the land hub.
