Subletting a Rental in Uganda: What the Law Allows
Updated 3 November 2026 · Land & Property editorial team
A tenant in Uganda may sublet the whole or part of rented premises only with the landlord's written consent, and the landlord must not unreasonably refuse (section 32, Landlord and Tenant Act, 2022). A sublet or assignment without consent is invalid and immediately terminates the tenancy (section 33). Short-letting on a booking platform without permission carries the same risk.
- Subletting
- Needs the landlord's written consent (section 32(1))

- Landlord must not unreasonably withhold it (section 32(2))
- Without consent
- Invalid and immediately terminates the tenancy (section 33)

- Same rule: written consent (section 31)
Can I sublet my rented house or flat in Uganda?
Yes, but only with the landlord's written consent. Section 32 of the Landlord and Tenant Act, 2022 (Act 9 of 2022) says that a tenant must not sublease the whole or any part of the premises without the landlord's written consent, and that a landlord must not unreasonably withhold that consent. The Act's definition of "lease" in section 2 includes a sublease, and its definition of "tenancy" includes a sub-tenancy, so a sublet is a real tenancy with its own rights. Section 31 applies the same written-consent rule to assigning, which means handing your whole tenancy to another person.
The rule covers "the whole or any part". Renting out one room to a lodger, letting a friend take over a bedroom for a fee, and letting the whole flat while you travel are all subletting. Having a family member live with you, with no rent, is not a sublease, though your agreement may limit the number of occupants, so read it.
What happens if I sublet without the landlord's consent?
Section 33 is strict. An assignment of a tenancy, or a subleasing of the whole or any part of the premises, by a tenant without the consent of the landlord is invalid and immediately terminates the tenancy. That puts at risk your home, your deposit and your standing as a tenant. The person you sublet to also has a weak position, since a sublease that is invalid under the Act may leave them without a legal right to stay.
Termination is not always the end. Section 41 lets a tenant or landlord challenge a termination in court. If the court finds that the termination was not justified or not in accordance with the Act, it may order that the tenancy be reinstated or award damages. A tenant must pay rent while challenging it (section 41(3)). The landlord also still must not evict you except in accordance with the Act or the agreement, and section 45 gives an unlawfully evicted tenant a claim to relief in court or an equivalent of three months' rent, plus damages. Do not use that as a reason to sublet in secret, because section 33 is written against the tenant who does.
How do I get the landlord's consent, and what should the agreement say?
Ask in writing, in a letter or a message that the landlord answers in writing. Section 32(1) needs written consent, so a spoken yes or a nod does not meet it. Give the landlord enough to decide on:
- who the sub-tenant is, with their identification (section 3(5) requires a landlord to see an ID before entering a tenancy with an individual);
- whether it is the whole premises or a room;
- the period, the rent and the deposit you will take;
- who pays the power, water and any service fee, since these depend on the meters (sections 12, 13 and 46);
- who answers to the landlord for damage and nuisance, because the landlord's agreement is with you, not with the sub-tenant. Section 16 requires you to take care not to damage the premises, and sections 14 and 15 forbid unlawful use and nuisance by you and by people you permit to use the premises.
Put the sublease in writing too. A sublet agreement should follow the points in Tenancy Agreement in Uganda, and give the sub-tenant a written receipt for every payment. Keep copies, and the landlord's consent, with your rent records. See Rent Receipts and Records: What Tenants Should Keep.
A landlord can refuse for a good reason, such as a sub-tenant with no ID, a plan to run a business in a family home, or a number of people the building cannot hold. The Act does not define "unreasonably", so there is no checklist and a refusal you think unfair would be settled by a court. In practice, offer to meet the landlord and the sub-tenant.
Can my landlord stop me from using Airbnb or short stays?
Yes, unless the landlord consents. Letting a room or the flat to paying guests through a booking site is subletting part or all of the premises, so section 32 applies, and so does section 33 if you do it without consent. The agreement may also ban business use or limit visitors. Sections 14 and 15 forbid using the premises for an unlawful purpose and causing nuisance to neighbours, and short stays are a common source of neighbour complaints. A landlord who finds out can serve notice. For a monthly tenancy the Act sets thirty days (section 38), while a landlord who relies on section 33 treats the tenancy as already ended, a position that can be challenged in court under section 41.
Section 1(3)(b) says the Act does not apply to residence in a hotel, motel or other transient lodging. We found no court decision that says where a short stay in a private flat falls, so do not assume that the guests are outside the Act or that you are outside the rules. Short-stay hosts should read Short-Let and Airbnb Rules and Tax in Uganda and the income tax rules at rental income tax.
If you own the property rather than rent it, the position is simpler. An owner who wants short stays can contact us to ask what is possible for their property. Tenants who want that income should talk to the owner first and ask for written consent.
What should I do before I sublet, and what if I am the landlord?
Before you sublet, read your agreement for clauses on subletting, assigning, business use and the number of occupants. Section 11(1) makes void a term that excludes or restricts a provision of the Act, but a clause that asks for written consent is the same rule the Act states, so it is valid. Ask for written consent. Then document the sublease, vet the sub-tenant and keep paying your own rent on time. If your landlord is slow to answer, say so in writing and do not sublet in the meantime.
If you are the landlord, put your policy in the agreement from the start, say whether you accept short stays, and reply to a request in writing within a stated time. Decide what you want to protect: the building's quiet, the number of occupants, the insurance and your tax records. If you plan to sell, a sub-tenant adds a layer for the buyer to check; see Selling a House With Tenants in It. When viewing a place to rent, use the house viewing checklist and ask about subletting before you sign. Frequently asked questions
Can I sublet my apartment?
Only with the landlord's written consent. Section 32 of the Landlord and Tenant Act, 2022 bars subletting the whole or part of the premises without it, and says the landlord must not unreasonably withhold consent. Ask in writing and keep the answer.
Can my landlord stop me from Airbnb?
Yes, unless the landlord agrees in writing. Letting guests pay to stay is subletting, which section 32 covers. Doing so without consent makes the sublet invalid and ends your tenancy immediately under section 33. Your agreement may also ban business use.
What if my landlord refuses without a reason?
Section 32(2) says a landlord must not unreasonably withhold consent, but the Act does not define the term. Ask for the reason in writing and try to meet it. If a dispute follows, it is decided by a court, which includes local council courts.
Is a sublease without consent valid?
No. Section 33 says a sublease or assignment made without the landlord's consent is invalid and immediately terminates the tenancy. A tenant can challenge a termination in court under section 41, but must keep paying rent while doing so.
Does having a lodger count as subletting?
If the lodger pays you for a room, yes. Section 32 covers subletting any part of the premises. Letting a relative stay without rent is not a sublease, but check your agreement for limits on who may live in the home.
