US Tax on Uganda Property: FBAR, FATCA, Rental Income

Updated 3 November 2026 · Land & Property editorial team

US citizens and residents are taxed on worldwide income, so rent or gains from Uganda property can belong on your US return. As of November 2026, the IRS says foreign real estate held directly is not reported on the FBAR or Form 8938, but Ugandan bank accounts can trigger the FBAR above USD 10,000. PwC lists no US-Uganda tax treaty. Ask a US tax professional.

FBAR threshold
Foreign accounts above USD 10,000 in total at any time in the year (IRS)
FBAR due date
15 April, with automatic extension to 15 October (IRS)
Foreign real estate held directly
"No" for both FBAR and Form 8938 (IRS comparison chart)
Uganda rental tax, individuals
12% of gross rent above UGX 2,820,000 a year (URA)

Must I report land in Uganda to the IRS?

It depends on what you hold and how. The IRS comparison chart of Form 8938 and FBAR requirements, last updated on 19 September 2026, lists "foreign real estate held directly" as "No" for both forms. So land or a house in your own name is not reported on the FBAR or Form 8938 for that reason alone. This is the position as of November 2026, and it applies to property you own directly, not through a company or other entity.

That does not mean the property is invisible to the US tax system. The IRS says US citizens and resident aliens abroad generally file as other US filers do, and whether you must file depends on gross income from worldwide sources. Rent you earn from a Ugandan house is income. A gain on a sale can also be taxable, and you should ask a US tax professional how to calculate it, including how any Ugandan tax you paid is treated. This page is information, not tax advice, and rules change each year.

What is the FBAR and when do Ugandan accounts trigger it?

The FBAR is the Report of Foreign Bank and Financial Accounts, filed on FinCEN Form 114. The IRS says you must file if you are a US person with a financial interest in, or signature authority over, foreign financial accounts whose combined value is more than USD 10,000 at any time in the calendar year. It is due on 15 April for the previous year, with an automatic extension to 15 October, and it is filed electronically with FinCEN, not with your tax return. The IRS says to keep records for five years and that civil and criminal penalties can apply to reporting failures.

The link to property is practical. If you open a Ugandan bank account to receive rent or hold sale proceeds, or you hold a joint account with a relative who manages the property, the balance counts toward the USD 10,000 total. Check every account on which your name appears, even if you never use it. What is FATCA reporting, and does Form 8938 apply?

FATCA reporting for individuals is done on Form 8938, which is attached to your income tax return. The IRS sets these thresholds for the total value of specified foreign financial assets, shown as year-end value / value at any time in the year:

Your situationYear-endAny time in year
Living in the US, unmarriedMore than USD 50,000More than USD 75,000
Living in the US, married filing jointlyMore than USD 100,000More than USD 150,000
Living abroad, unmarriedMore than USD 200,000More than USD 300,000
Living abroad, married filing jointlyMore than USD 400,000More than USD 600,000

The IRS says Form 8938 does not replace the FBAR, and the two forms use different definitions. Directly held foreign real estate is not a specified foreign financial asset, but an interest in a foreign entity can be. If you hold your Uganda property through a company or a trust, ask a US adviser whether that interest counts. Forms 3520 and 3520-A are separate IRS forms for certain foreign trusts and foreign gifts, which can matter if a relative leaves you Ugandan property, so ask your adviser. How is rent from Uganda taxed in Uganda?

The Uganda Revenue Authority (URA) says individual landlords pay 12% on the part of gross annual rental income that is above UGX 2,820,000, and its page mentions no expense deduction for individuals. Landlords declare the income themselves. As an example based on URA's figures, gross rent of UGX 10,000,000 gives tax of UGX 861,600. URA's page does not set out how the rule applies to a landlord who lives abroad. A different rule can apply if you count as a non-resident: the Income Tax Act (sections 82 and 87 and Schedule 4) sets a final tax of 15% on gross rent for non-residents, so ask URA or a tax adviser which rate applies to you. Ask URA before you fix your rent or your tax plan. Our guide to rental income tax covers the rules for all landlords.

Keep proof of every payment of Ugandan tax. Whether and how it reduces your US tax is a question for your US adviser, and it depends on the income type. Keep rent receipts, repair invoices, bank statements and the tax payment receipts in one folder for each year, because your US adviser will ask for them in dollar terms. If a UK-based relative is in the same position, our page on UK Tax on Uganda Property for UK Residents covers the UK rules.

Is there a US-Uganda tax treaty?

PwC's Uganda tax summary lists Uganda's double tax agreements with Denmark, India, Italy, Mauritius, the Netherlands, Norway, South Africa, the United Kingdom and Zambia. The United States is not on that list. Based on that source, as of November 2026 there is no US-Uganda income tax treaty that would set the order in which each country taxes your rent or gain. We have not confirmed this with URA or the IRS, so ask your adviser to check the current treaty lists.

Without a treaty, you rely on each country's own rules to avoid being taxed twice. PwC notes that Uganda lets an individual claim credit for foreign tax on foreign-source income that is also taxed in Uganda, limited to the Ugandan tax on that income. That rule is about Uganda residents, so it does not help you directly if you are a US resident with Ugandan property. The US credit rules are separate.

What should I keep and ask before I buy?

  • Ask a US tax professional who knows foreign property to set out your filing list for the property and any Ugandan account.
  • Keep your purchase price, legal fees and stamp duty receipts, as these establish your cost. Our guide to the cost of buying land in Uganda from abroad is a good starting list, though you should confirm it with your adviser.
  • Check any Ugandan bank accounts and mobile money wallets against the FBAR rules.
  • Record your exchange rate each time you convert, because US returns are in dollars.
  • Do not hold the land through a relative's name to avoid reporting. It can create legal and tax problems, and our guide land title in my name while abroad sets out the legal risk.

When you are ready to look at land, browse plot listings and book an escorted site visit. In our own listings, the median asking price for plots was UGX 155 million in November 2026 (Land & Property listings, Nov 2026). Asking prices are not sale prices.

Frequently asked questions

Must I report land in Uganda to the IRS?

The IRS comparison chart lists foreign real estate held directly as not reportable on Form 8938 or the FBAR. Income from it, such as rent, is still part of your worldwide income, and an interest in a foreign company may be reportable. Ask a US tax professional about your own case.

Is there a US-Uganda tax treaty?

PwC's Uganda tax summary lists treaties with Denmark, India, Italy, Mauritius, the Netherlands, Norway, South Africa, the United Kingdom and Zambia, and not the United States. As of November 2026 that suggests no treaty. We have not confirmed it with the IRS or URA, so check before you rely on it.

Does my Ugandan bank account trigger the FBAR?

It can. The IRS says an FBAR is due if the combined value of your foreign financial accounts is more than USD 10,000 at any time in the year. A Ugandan account, a joint account or one where you have signature authority all count. The report is filed electronically with FinCEN by 15 April, extended automatically to 15 October.

How is rent from Uganda taxed in Uganda?

URA says individual landlords pay 12% on gross annual rental income above UGX 2,820,000, with no expense deduction mentioned, and declare the income themselves. URA's page does not explain the rule for landlords who live abroad, so ask URA or a tax adviser how it applies to you.
